Against the wishes of the developer Mars Capital a further hearing day for the cornerstore DA will take place in Bundeena.

The original hearing days occurred on August 3rd & 4th. The August 3rd hearing took place in Bundeena while the August 4th hearing  took place in a city courtroom. The August 4th hearing led to amendments to the DA which triggered additional hearing dates for November 22nd & 23rd.

The November dates were expected to take place in a courtroom but Council's solicitors requested the first day be scheduled in Bundeena so that surveyed height poles could be erected at the site and the impact of the development could be better assessed. This request was vigorously opposed by the Mar's solicitors on the basis that resident objectors would simply repeat the evidence already given at the August 3rd hearing.

After hearing debate from both parties, the Court directed that the hearing should commence at 9:30am November 22nd on-site in Bundeena. The Court had also directed Council's solicitors to notify all objectors that the Court has already taken into account all previous evidence and that any further evidence be confined as much as possible to the amended plans currently before the Court.
