A Oyster Bay man has been charged for the Bundeena Drive crash which occured last month in the Royal National Park. New Update (Aug 23rd).

The man aged 19 was the driver of the vehicle which resulted in the death of 17 year old Kim O'Brien along with injuries to himself and two other passengers.  Police layed several charges including  dangerous driving occasioning death, dangerous driving occasioning grievous bodily harm, negligent driving occasioning death and being a learner driver not accompanied by a fully licensed driver.

The four youths none of which held a full license had been driving from Bundeena just before midnight when the driver lost control on Bundeena Drive's The Saddles and slammed into a gum tree. The crash occurred within 48 hours of a new law which had come into affect which banned first year drivers from carrying passengers at night.

The Saddles which is road signed with a Black Spot marking had been resurfaced in 2005.

The mother of the charged driver had not spoken with her son for two years until the crash had occurred. She was distraught to learn from media reports the occurrence of the crash and the subsequent laying of charges.

The man is scheduled to face proceedings at Sutherland Court on August 23rd.

Tony Biggart, the charged driver entered no plea to the charges at the hearing held at Sutherland Local Court.

Police alleged that Biggart had "a lengthy history for driving matters". However, he was released on a conditional $1000 bail bond. The conditions include having no contact with victims or friends of those in the accident as well as not driving any motor vehicle. Any breach of the bail conditions will result in forfeiting the bond as well as requiring him to report to police three times per week.

Proceedings will resume on October 4th at Downing Centre District Court.
