Corner Store LEP Hearing Update

Further proceedings regarding the cornerstore DA may be held in Bundeena after the case could not be concluded after two days of hearings.

The LEP court case for  the  old cornerstore site is expected to require an additional two days of hearings. The dates set are Novemeber 22nd & 23rd one of which may be held  in Bundeena.

Residents initially got to express their opinions of on the first day of  hearings held onsite in Bundeena. The second day of  hearings  was held in a LEP courtroom in the city and involved both Council and developor solicitors as well as the court appointed expert .

The court appointed expert had admitted that the current Bundeena DCP calls for a 0.7 to 1 building to land ratio as well as a 50/50 residential/commercial mix but he detailed a case why it should not be followed. As well the commissioners indicated the following:

  • No objection to adjoining Loftus house views
  • Depth of escavation is acceptable
  • Driveway could be reduced from two lane to single lane
  • The space of 1.5m from building to property line was acceptable
  • The # units should be reduced from ten to nine to conform to the indicative building footprint for the subject site in the DCP
  • Loss of views to neighbouring IGA building not acceptable

The ammendments to the DA indicated by the commissioner has triggered the additional hearing days. The developer is to submit the ammended plans and this will allow all parties concerned to review them and be deliberated in court.

The developer has already submitted  the revised plans and Council has already been distributed to residents for review (DA04/1213). Comments to Council need to be in by September 14th 2006 4:30pm.
